By accessing or using Windows.Contractors (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and Team Capital Investments, LLC ("Company," "we," "us," or "our").
Windows.Contractors provides a done-for-you lead automation platform for window replacement contractors. The Platform includes a branded lead capture funnel, CRM dashboard, automated SMS and email follow-up sequences, calendar booking system, cold email broadcast tools, and related features (collectively, the "Service"). The Service is provided on a subscription basis following a one-time setup fee.
You must be at least 18 years of age and operating a legitimate window replacement or home improvement business to use the Service. By using the Platform, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorized access to your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
The Service requires a one-time setup fee of $4,997 (or two payments of $2,797 under the Two Pay plan) plus a monthly subscription fee of $297 per month following setup. All fees are charged in U.S. dollars and processed securely through Stripe. The setup fee is non-refundable once your system has been built and delivered. Monthly subscription fees are billed in advance each month. You may cancel your monthly subscription at any time with no penalty; cancellation takes effect at the end of the current billing period. We reserve the right to change our pricing with 30 days' written notice to active subscribers.
Setup Fee: The one-time setup fee is non-refundable once we have begun building your system (typically within 24 hours of payment). If you cancel before we begin setup, you are entitled to a full refund. Monthly Subscription: Monthly fees are non-refundable for the current billing period. You may cancel at any time to prevent future charges. If you believe you were charged in error, contact us at [email protected] within 30 days of the charge.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to: • Send unsolicited commercial messages (spam) to individuals who have not consented to receive communications from you. • Use the Platform to harass, threaten, or defraud any person. • Attempt to gain unauthorized access to any part of the Platform or its infrastructure. • Violate any applicable federal, state, or local laws or regulations, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any applicable state telemarketing laws. You are solely responsible for obtaining proper consent from homeowners before sending them SMS or email communications through the Platform.
You acknowledge that you are responsible for compliance with all applicable laws governing SMS and email marketing, including the TCPA and CAN-SPAM Act. You represent that all contacts added to your lead database or broadcast campaigns have provided appropriate consent to receive communications. We provide the technology; you are responsible for how you use it. We reserve the right to suspend or terminate your account if we receive credible reports of TCPA violations or spam complaints originating from your account.
The Platform, including its software, design, content, and trademarks, is owned by Team Capital Investments, LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform solely for your internal business purposes during your subscription term. You may not copy, modify, distribute, sell, or sublicense any part of the Platform.
You retain ownership of all lead data and business data you input into the Platform. We process this data on your behalf as a service provider. Upon cancellation, you may export your lead data in CSV format before your account is closed. We are not responsible for data loss after account closure.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST LEADS, OR LOST BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR SPECIFIC BUSINESS REQUIREMENTS OR THAT IT WILL GENERATE ANY PARTICULAR NUMBER OF LEADS OR REVENUE.
You agree to indemnify, defend, and hold harmless Team Capital Investments, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, your violation of any applicable law, or your infringement of any third-party rights.
Either party may terminate the monthly subscription at any time. We reserve the right to suspend or terminate your account immediately, without notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or the integrity of the Platform. Upon termination, your right to access the Platform ceases immediately. You remain responsible for any fees incurred prior to termination.
These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Fulton County, Georgia, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.
We may update these Terms from time to time. We will notify you of material changes by email and by posting the updated Terms on this page with a revised date. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
